Invokana and Resulting Injuries

Prescription medications often times can produce side effects. After all, almost every commercial for a new type of drug ends with a disclaimer regarding numerous side effects and warnings. In addition, some people experience adverse drug reactions due to allergies or combinations of medications. However, some pharmaceutical companies release drugs onto the market knowing that the drug causes dangerous and disturbing side effects.

The Food and Drug Administration (FDA) approved Invokana to treat Type 2 diabetes in adults, and the drug hit the shelves in 2013. One of a new class of drugs called sodium-glucose cotransporter 2 (SGLT2) inhibitors, they work by preventing the bloodstream from reabsorbing glucose, thereby lowering blood sugar levels. Invokana was the first SGLT2 inhibitor approved by the FDA. A couple more, Invokamet and extended release Invokamet, have followed. This class of drugs enjoys increasing popularity, and Invokana earned Johnson & Johnson more than $1.4 billion in 2016 alone.

While many people find Invokana effective at controlling blood sugar, common side effects include urinary tract infections, abdominal pain, genital mycotic infections, nausea, constipation, yeast infections, and more. While these side effects can inconvenience patients and may require a course of antibiotics, the more serious effects of Invokana include:

  • Low blood pressure
  • Kidney infections
  • Kidney failure
  • Blood infections
  • Hyperkalemia
  • Bone fractures
  • Ketoacidosis
  • Amputations

All of the above constitute serious conditions, but the main subjects of Invokana lawsuits are ketoacidosis and amputations. Let’s take a closer look at these two life-changing side effects of this drug.

Ketoacidosis

Diabetic ketoacidosis occurs when a person’s body has too little insulin or no insulin and can no longer use sugar for energy. Instead, the body begins to use fat as a fuel source, which produces blood acids called ketones in the system. A buildup of ketones can create toxins in the body, leading to dangerous reactions that require emergency care.

Many symptoms can indicate developing ketoacidosis, including:

  • Confusion
  • Weakness
  • Fatigue
  • Shortness of breath
  • Frequent urination
  • Vomiting and nausea
  • Increased thirst
  • Abdominal pain
  • Sweet or fruity smelling breath
  • Home tests that show high levels of ketones or hyperglycemia

If you cannot keep food down without vomiting, have high ketone levels, or have trouble getting your blood sugar levels down, immediately seek medical treatment for possible ketoacidosis. If you fail to seek necessary help, this condition can become fatal.

Even after you seek treatment, you may experience different complications from ketoacidosis, including swelling of the brain, low potassium levels, or low blood sugar. Treatment often requires hospitalization, and people taking Invokana can repeatedly experience this issue. The FDA started requiring a Black Box warning for ketoacidosis on Invokana packages in 2015.

Amputations

Amputations already present serious problems for people with Type II diabetes. Diabetes can reduce blood flow to the feet, which reduces pain sensations. Patients may not realize they developed ulcers or sores on their feet or legs. The ulcers or sores can then become infected, and the wounds may not heal due to the reduced blood flow. The tissue can become irreparably damaged or may die, which can require the amputation of the body parts. Toes, feet, and legs are the most commonly amputated body parts due to this complication.

Clinical trials have indicated that the risk of amputations increases significantly for people taking Invokana. In 2017, the FDA issued a Black Box warning regarding this increased risk based on the clinical trial results. The results showed that patients taking Invokana had at least twice the incidence of amputations as patients taking placebos. Amputations included:

  • Toes
  • Middle of the foot
  • Leg below the knee
  • Leg above the knee
  • Multiple limbs
Amputations are an extremely serious medical event that can change your life. Drugs should not have side effects that severely increase your risk for permanent disabilities, so many Invokana takers have unsurprisingly filed lawsuits after they required an amputation.

Facing Extensive Losses

Both ketoacidosis and amputations can result in physical, emotional, and financial losses. First, ketoacidosis often requires that you visit the emergency room and may require your admission to the hospital for several days until your ketone levels stabilize. If you suffer brain swelling or any other complications from ketoacidosis, your time in the hospital can extend and your treatment costs will substantially increase.

In addition to incurring medical expenses, conditions like ketoacidosis can cause you to miss a substantial amount of work. This can result in missed paychecks, which can cause serious problems with your household budget. People who miss work due to illnesses and hospitalizations often can take months to get back on trackif they ever do. The losses add up quickly. Patients who don’t realize they have ketoacidosis in time could suffer permanent harm or may even die due to the condition. In these situations, they can leave family members facing harsh emotional and financial losses.

The losses from an amputation can prove even more extensive than ketoacidosis. An amputation is a risky surgical procedure to begin with. Many things can go wrong during amputation surgeries that can lead to life-threatening complications. In addition, many people with diabetes who require amputations have difficulty healing, so the recovery process can prove long and difficult.

An amputation is a permanent disfigurement of the body, and the aftermath can result in different impairments. Patients may need medical equipment to walk or may need to use wheelchairs to get around. This is a very painful procedure, as well, and the pain can persist long after the body part is gone.

Disabilities from amputations may also prevent someone from returning to their previous jobs, participating in their favorite activities, or even completing basic tasks around the house. Not only can they lose earnings for the rest of their lives, but temporary loss of enjoyment of their lives. Even if you qualify for a prosthesis, learning to use it can prove difficult and painful. Prosthetics can also cost substantial amounts of money and can never completely replace your own limb or extremity.

If you suffered from ketoacidosis or an amputation because you took Invokana, discuss your legal rights with an experienced pharmaceutical injury lawyer as soon as possible. Many people have brought forward legal claims due to Invokana injuries, and the attorneys at Stewart J. Guss, Injury Accident Lawyers, can help their clients do the same.

Taking on Johnson & Johnson

Pharmaceutical companies have a duty to sell drugs that are safe for their intended users. They owe consumers proper warnings about potential side effects of any medication. That way, patients can make educated decisions about whether they want to take the medication or not. Medications should not produce life-threatening side effects or cause unnecessary medical conditions or injuries. No one deserves to worry about a more severe side effect of a medication they’re using to treat an initial ailment!

Invokana was on the market for two years before Johnson & Johnson began warning people about the possibility for ketoacidosis, and four years before providing warnings about the increased amputation risk. In addition, Johnson & Johnson continues to sell Invokana knowing that it canand doescause serious harm.

When patients suffer due to a pharmaceutical companys negligence, those patients should hold the company liable for the harm it caused. The law gives injured consumers the right to file a personal injury lawsuit applying products liability principles.

Invokana lawsuits are not ordinary products liability claims, however, due to the sheer number of people who are seeking redress for the harm they suffered. When hundreds or more people file similar lawsuits, the cases can combine into one class-action lawsuit consolidated in federal court.

Mass tort cases like those stemming from Invokana have their own specific rules and procedures. This is a different process than filing a personal injury claim at your local civil courthouse. You need a lawyer who understands how to handle such class action suits and will represent your rights as a member of the injured class.

Another complicating factor of Invokana cases: Johnson & Johnson is a Fortune 500 company with more 250 subsidiaries and more than $70 billion in annual sales. The company has a large legal department ready to fight against their liability for consumer injuries. It takes massive resources to fight against such a corporate giant in court.

However, Johnson & Johnson is no stranger to the court system. In 2013, the company paid the third-largest pharmaceutical settlement to the Department of Justice due to problems with the drug Risperdal. The company has also faced lawsuits in recent years regarding the talcum powder it had sold for decades, because users claim to have suffered from an increased risk of ovarian cancer.

With the right law firm on your side, you can seek financial recovery, even from companies as large as Johnson & Johnson. Some damages involved in Invokana cases may include:

  • Past medical expenses
  • Costs of future medical treatments
  • Lost income
  • Future lost earning capacity
  • Lost enjoyment of life
  • Permanent disability or disfigurement
  • Pain and suffering
  • Mental trauma
  • Wrongful death

Whether you or a loved one has sustained serious injuries or even death due to the dangerous side effects of Invokana, do not wait to learn about your rights and options for compensation.

Review: 5/5
★ ★ ★ ★ ★

“As a relatively new resident of Houston, I did not know of an attorney to contact for a personal injury suit. I randomly went through the yellow pages contacting two attorneys that had rejected my case prior to me contacting Stewart Guss. Stewart took my case on and settled for far more than I had anticipated. The silver lining of this is that I will now have enough money to go back to school for retraining, so I will be able to reenter the workforce in a new capacity. The paralegal, Angela, was kind and supportive throughout the process. If I did not understand the legal jargon, I did not hesitate to ask, and was never once made to feel that I was incompetent. Thank you Stewart and Angela for giving me a new lease on live.”
